Terms of Service

These Terms of Service ("Terms") govern access to and use of market4.me (the "Service"), operated by Bleart Emini, a sole proprietor ("we," "us," "our"). By creating an account, you agree to these Terms.

1. What the Service Does

market4.me is a chat-driven tool that helps local service businesses draft advertising campaigns. You describe a campaign in a chat interface; our AI drafts ad copy, targeting recommendations, and (optionally) ad creative images. **You review and must explicitly approve every draft before anything is finalized.** The Service never publishes an ad or spends your advertising budget without your explicit approval.

By default, once you approve a draft, the Service produces a formatted brief that you copy into Meta Ads Manager (or another platform) yourself. If you choose to connect your own Meta advertising account (in Settings), an approved draft can instead be published directly to that account through the Meta Marketing API — but only in a paused state, and only after you give a second, separate confirmation to make it active. We only ever publish to an advertising account you have connected yourself; we never operate through a shared or agency account on your behalf.

2. Your Account

  • You must provide accurate business and contact information at signup and keep it current.
  • You are responsible for maintaining the confidentiality of your account password and for all

activity under your account.

  • You must be authorized to act on behalf of the business you're signing up (i.e., you're not

impersonating another business or acting without authority to bind it).

  • You must be at least 18 years old, or of legal age to enter a binding contract in your

jurisdiction if that is older than 18.

3. AI-Generated Content

  • Ad copy and targeting recommendations are generated by a third-party AI model (Anthropic Claude)

based on the business information and campaign goals you provide.

  • Ad creative images, when requested, are generated by a third-party image model (fal.ai) and are

cryptographically signed for content provenance before being shown to you or delivered to you, in accordance with applicable AI transparency requirements (including EU AI Act Article 50). We do not show or deliver unsigned AI-generated images.

  • **We run an automated ad-policy check on generated copy, but it is a best-effort tool, not a

guarantee of compliance with Meta's (or any platform's) advertising policies.** You are responsible for reviewing every draft yourself before publishing it anywhere, and for your own compliance with the advertising platform's policies and applicable law (including truth-in- advertising, health/medical claim rules, financial promotion rules, and non-discrimination requirements in ad targeting).

  • We make no guarantee about the performance of any ad you publish (leads, clicks, sales, or any

other outcome) — actual results depend on your budget, market, platform algorithm, and factors outside our control.

4. Your Content and Data

  • You retain ownership of the business information you provide and the final ad copy/creative you

approve.

  • We do not use your business or campaign data to train AI models beyond what's necessary to

generate your own drafts, and we do not sell your data to third parties.

  • If you cancel your subscription, your account data is retained for 90 days (to allow easy

reactivation) and then deleted, except where we're required to retain records by law.

  • A data processing addendum (DPA) is not included here; it's a separate document to produce if a

client asks for one for their own compliance needs.

5. Third-Party Services

Delivering the Service involves the following subprocessors, each governed by their own terms: Anthropic (ad copy generation), fal.ai (image generation), Certivu (image content-provenance signing), Stripe (billing/payments), MongoDB Atlas (database hosting), Upstash (rate limiting), Fly.io and Cloudflare (application hosting), and Sentry (error monitoring). 6. Billing

  • Paid plans are billed monthly or annually in advance through Stripe, per the tier you select.
  • No refunds for partial billing periods. You may cancel at any time and will retain access until

the end of your current billing period.

  • We may change plan pricing with 30 days' advance notice to existing subscribers.
  • Usage limits (campaign count, AI generation calls per day) are enforced per your plan tier and

reset daily/as specified in your plan.

7. Acceptable Use

You agree not to use the Service to generate advertising for illegal products or services, content that violates a third party's rights, or content you know to be false or misleading. We may suspend or terminate accounts that violate this section.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST ADVERTISING SPEND, OR ACCOUNT SUSPENSIONS/BANS ON THIRD-PARTY AD PLATFORMS RESULTING FROM CONTENT YOU CHOSE TO PUBLISH. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

You may cancel your subscription at any time from account settings. We may suspend or terminate your account for violation of these Terms or the Acceptable Use section above.

10. Dispute Resolution

There is no mandatory arbitration clause or class action waiver. Disputes will be resolved through the court system as described in the Governing Law section below.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Georgia, and you consent to personal jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. We'll notify you by email at least 30 days before material changes take effect.
